1. Intellectual Property
The Service and its original content, features, and functionality are and will remain the exclusive property of TLB City Publishing and its licensors. The Service is protected by copyright, trademark, and other laws of both India and foreign countries. Our trademarks and trade dress may not be used in connection with any product or service without the prior written consent of TLB City Publishing.
For Published Authors: Manuscripts, books, covers, and associated content submitted to and published by TLB City Publishing are governed by individual Publishing Agreements. These Terms do not override the specific terms of any signed contract between you and TLB City Publishing.
2. Literary Services
2.1 Service Description: We offer various literary services, including but not limited to manuscript assessment, editing, proofreading, formatting, and author coaching (“Services”).
2.2 Service Agreements: The scope, deliverables, timeline, and fee for any Service will be outlined in a separate written agreement, estimate, or invoice (“Service Agreement”). In the event of a conflict, the terms of the Service Agreement shall prevail over these general Terms.
2.3 Client Responsibilities: You agree to provide all necessary materials and information required for us to perform the Services in a timely manner. You represent that you own or have the necessary rights to any manuscript or content you provide to us.
2.4 No Guarantee: While we strive for excellence, we cannot guarantee any specific outcome from our Services (e.g., publication, literary agent representation, or sales success).
3. Online Store – Merchandise and Books
3.1 Products: We sell physical merchandise through our online store.
3.2 Order Acceptance: All orders are subject to product availability and acceptance by us. We reserve the right to refuse or cancel any order for any reason, including errors in product description or pricing.
3.3 Pricing and Payment: Prices for our products are subject to change without notice. We are not liable for any typographical errors regarding price or product information. You agree to pay the price current at the time of order.
3.4 Shipping and Risk: Title and risk of loss for all physical products pass to you upon our delivery to the carrier. Shipping times are estimates and are not guaranteed. You are responsible for providing a correct shipping address.
3.5 Returns and Refunds (Merch): Due to the nature of custom and print-on-demand merchandise, all sales are final unless the item is defective or damaged upon arrival. Please contact us within three days of delivery to initiate a refund or replacement for damaged or defective merchandise.
4. User Accounts
When you create an account or place an order with us, you must provide information that is accurate, complete, and current at all times. Failure to do so constitutes a breach of the Terms.
You are responsible for safeguarding the password and for any activities or actions under your account. You agree not to disclose your password to any third party.
5. Links To Other Websites
Our Service may contain links to third-party websites or services that are not owned or controlled by TLB City Publishing. We have no control over, and assume no responsibility for, the content, privacy policies, or practices of any third-party websites or services. You further acknowledge and agree that TLB City Publishing shall not be responsible or liable, directly or indirectly, for any damage or loss caused or alleged to be caused by or in connection with use of or reliance on any such content, goods, or services available on or through any such websites or services.
6. Termination
We may terminate or suspend your account and bar access to the Service immediately, without prior notice or liability, for any reason whatsoever, including without limitation if you breach the Terms.
7. Limitation of Liability
In no event shall TLB City Publishing, nor its directors, employees, partners, agents, suppliers, or affiliates, be liable for any indirect, incidental, special, consequential or punitive damages, including without limitation, loss of profits, data, use, goodwill, or other intangible losses, resulting from:
(i) your access to or use of or inability to access or use the Service;
(ii) the cost of procurement of substitute goods or services resulting from any goods, data, information, or services purchased or obtained through the Service;
(iii) unauthorized access to or alteration of your transmissions or data;
(iv) the conduct of any third party on the Service; or
(v) any other matter relating to the Service.
